1. TERMS & CONDITIONS:

SADV (Pty) Ltd. (hereinafter referred to as “the Promoter”) is running a deal named SADV Exclusive Black Friday Fibre Deal (hereinafter referred to as “the Deal”).
Any person who enters (hereinafter referred to as “the Subscriber”) agrees that they have read, understand, and accept the Terms and Conditions of the Deal that are set out below and are binding on the Subscriber in their personal capacity.

2. DEAL RULES:

The deal will go live as a Facebook post and ad on 29 November 2024. This will run until 31 January 2025.
Deal Details: SADV is launching an unbeatable prepaid fibre offer for anyone looking to upgrade their internet connection without breaking the bank. For a limited time, customers can enjoy 30 Mbps download and 10 Mbps upload speeds for only R399 per month for the first 3 months. Available from 29 November 2024 until 31st January 2025, giving you plenty of time to get connected to fast, reliable internet.
In addition to the discounted price, the first 1000 people to sign up or upgrade to a 30/10 Mbps package between 29 November 2024 and 31 January 2025 will receive a free UPS (with free installation and activation) and pay R399 monthly for the first 3 months, then R419 afterwards. 3. DEAL DATES:

The Deal will be launched on 29 November 2024.
The Deal ends on 31 January 2025.

4. IMPORTANT NOTICE:

These Deal rules contain certain terms and conditions which appear in a similar text style to this clause and which:

May limit the risk or liability of the Promoter or a third party; and/or
May create risk or liability for the Subscriber; and/or
May compel the Subscriber to indemnify the Promoter or a third party; and/or
Serves as an acknowledgement, by the Subscriber, of a fact.
The Subscriber cannot be a juristic entity and must be an individual who is either an existing or new “SADV customer”.
Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit, or avoid any rights or obligations, as the case may be, created for either the Subscriber or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (“the CPA”).
The Subscriber acknowledges that by submitting his or her subscription to the Deal, he/she has been given an appropriate opportunity to first read these terms and conditions before subscribing and he/she understands and agrees to the terms and conditions.
The Promoter reserves the right to amend the terms and conditions, as well as suspend or terminate the Deal or extend any time frames at any time. In the event of such suspension, termination or extension, all participants agree to waive any rights that they may have in terms of the Deal and acknowledge that they will have no recourse against the Promoter, its advertising agencies, advisors, suppliers and nominated agents.
All Subscribers to this Deal participate entirely at their own risk. By reading and accepting these terms and conditions, the Subscriber hereby indemnifies the Promoter, the Promoter’s directors, employees and/or agents of any and all liability pertaining to any damage, cost, injuries, and losses of whatever nature sustained as a result of their participation in the Deal and the use of the prize.
The Promoter’s decision will be final. No correspondence will be entered into.
This Deal is in no way associated with any of the media platforms on which its communications, materials, or messaging appears, aside from those owned and operated by the Promoter.

6. TO QUALIFY FOR A SUBSCRIPTION INTO THE DEAL:

The Subscriber must reside in the countries in which the Promoter specifically advertises and sells, in this case, the Republic of South Africa.
The Subscriber must be 18 years or older.
The Deal excludes the Promoter, the Promoter’s advertising agencies, any directors, members, partners, sales force representatives, agents, employees or consultants of the Promoter, any supplier of goods or services in connection with the Deal and the spouse, life partner, business partner or associate, parent, child, or sibling, of any of the specified persons aforesaid.
The subscriptions will be selected as per the deal mechanics.
The Promoter will notify the winners via their contact details they’ve provided.
The Promoter reserves the right to disqualify any person that it knows is, or has reasonable grounds to believe is, ineligible for the deal. The Promoter accepts no responsibility for any damage, loss, injury, or disappointment of any kind suffered by any Subscriber in subscribing to the Deal. The Promoter accepts no responsibility for entries lost or delayed by computer error in transit. Signups made online using methods generated by a script, macro or the use of automated devices will be void.
By subscribing to the Deal, Subscribers agree to receive future correspondence from the Promoter, from which they may opt out at any stage.
By subscribing to this Deal, each Subscriber grants the Promoter a royalty-free, irrevocable, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display the Subscriber’s subscription into the Deal (including the photograph/video and all other content submitted by the Subscriber) in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including but not limited to on any and all Internet media, including the Promoter’s websites and properties and on social networking sites (i.e. Facebook, Instagram, YouTube, Twitter, etc.) for any legal purpose whatsoever. Such a license shall be valid for a period of 12 months after the Deal closes.
A Subscriber shall have no claim against the Promoter or anyone else relating to the use of their subscription. Subscribers will not receive any form of payment relating to the use of their entries.
By subscribing to the Deal, each Subscriber warrants and represents the following with respect to their subscription: the Subscriber is the sole and exclusive creator, author, and owner of the subscription; no rights in the subscription, or any portion thereof, have been granted to a third party, nor has any portion thereof otherwise been exploited in any way; and the subscription will not infringe on any rights of any third parties and will not give rise to any claims or infringement, invasion of privacy or publicity, or infringe on copyrights, trademarks, patents or other intellectual property rights or any rights or interests of any third party, or give rise to any claims for any payment whatsoever.

User data collected via subscription for this Deal will be stored for as long as it is legally required to and in accordance with the Protection of Personal Information Act, No 4 of 2013 and the Promoter’s Privacy Policy, Privacy Policy | SADV.
Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
By subscribing to the Deal, Subscribers acknowledge that the Deal will be managed in accordance with the provisions of the CPA. Qualifying Subscribers undertake to expeditiously do all things necessary to enable the Promoter to comply with their obligations under the CPA.
The Promoter will require the Winner to complete and submit an information disclosure agreement to enable the Promoter to ensure compliance with these rules. Should any Winner refuse or be unable to comply with this rule for any reason, such Winner will be deemed to have rejected the Prize and it shall revert to the Promoter.
